The US Senate has received a new bill called the Halting International Relocation of Employment Act. In other words, America is getting ready to slap a 25 percent penalty on businesses that outsource their work. The Indian IT sector would suffer a serious setback if this idea were passed into law. According to industry experts, this tax may result in a roughly 60% rise in the cost to American businesses.

American businesses will need to reevaluate their international outsourcing strategy if the proposed outsourcing law takes effect on January 1, 2026, the following year. If they don’t, they will have to pay excise duty, state taxes, and local taxes, which would raise the price significantly.

The Halting International Relocation of Employment (HIRE) Act was presented by US Republican Senator Bernie Moreno of Ohio. American businesses that hire foreign workers will be subject to a 25 percent tax if the US Parliament approves it. Any money raised by the proposed bill will go toward middle-class development initiatives in the United States.

What does the term outsourcing mean?

Any service fee, premium, royalty, or other payment made by a US taxpayer or business to a foreign organization that directly or indirectly benefits US customers is considered outsourcing, according to the proposed Act.

According to experts, this tax is not a corporate income tax but rather a form of excise charge. Only services directly used by American consumers would be impacted. Given that America is their largest market, this might be a very difficult situation for Indian IT companies.
